Terms of Use

1. What the offering is

Chroma (chroma.ch), Transarte (transarte.org) and Kinderdorf (kinderdorf.ch) are the same app under three names: painting courses, an AI painting coach, a gallery, sketch meet-ups, groups and a sketchbook diary with its own address under 1me.eu. Kinderdorf is the edition for children, with larger type and fewer features. The provider is Trifence AG, Winterthur, Switzerland (see legal notice).

2. Account, guest access, children

An account is personal. You are responsible for your password and your second factor. Accounts are possible from the age of 16.

You can also use the app without an account, as a guest. Guest access is tied to your browser: if you delete your browser data or switch devices, the access is gone along with your credit and your works, unless you have converted it into an account beforehand. To do so, add your email address in the credit section.

Children do not have their own account. Parents, godparents, teachers and course leaders create child profiles under their own account (first name or made-up name and a symbol). The sessions, works, medals and credit of a child profile belong to the account of the adult who is responsible for it. Anyone creating child profiles for children who are not their own, at school for instance, obtains the parents' consent. The coach answers children in short, simple language and without technical terms.

3. Your works belong to you

Everything you upload remains your property. We do not use your works for advertising, not for training AI models, and we do not pass them on. Only what you yourself set to "public" or release in a group, in the diary or as a testimonial becomes visible. If you publish works on Instagram, Pinterest or other services, the terms of the respective provider apply.

4. Credit

The AI coach costs credit, which is counted in "coffees"; in the app you can replace the word with tea, cocoa, lemonade and others, the counting always stays the same. Prices at the launch of this version: a picture with the "Assistant" coach a quarter of a coffee (one coffee is enough for four pictures), with the "Maestro" coach half a coffee, a child's work a quarter; the "Show me" sketch and the "Mark it in my photo" annotations a quarter each; the first three follow-up questions or interim reviews per picture free, after that a quarter for every three. The first picture is free, even without an account (once per person, device and image). Also free: requests for meeting points in a new region, new languages for the app, courses, gallery, diary, groups and calendar.

You buy credit in packages: 1 coffee CHF 3.70 / EUR 3.00, 5 coffees CHF 14.80 / EUR 12 (starter package), 12 coffees CHF 39.90 / EUR 32.40, 30 coffees CHF 88.80 / EUR 72, 100 coffees CHF 259 / EUR 210. Payment is via Stripe (card, TWINT, Bizum, Apple Pay, Google Pay). Schools order school packages against an invoice in francs with a QR payment slip: class for a semester 40 coffees CHF 54, class for a school year 80 coffees CHF 100, school 300 coffees CHF 330; the credit is added once payment is received. Credit is not money: it cannot be paid out, but it can be given away within the app. Purchased credit expires no earlier than three years after purchase. Every purchase comes with a printable receipt.

Welcome credit of ten coffees is granted once after a confirmed email address; it cannot be given away and is refused for disposable addresses. Association bonus: anyone who joins via the membership link of a partner association receives additional coffees with every purchase, in the amount agreed with the association (usually 10 per cent). Gifts by QR code or link expire unused after seven days and return to the giver; gifts to an email address go only to existing accounts and are credited immediately. If a payment is charged back, the corresponding credit is deducted again; a negative balance must be settled before the next session.

Right of withdrawal: Users in the EU may return unused, purchased credit within 14 days of purchase; write to the address in the legal notice. As soon as credit has been used, the right of withdrawal for that part lapses.

5. Inviting, ambassadors, shaping the app

You can invite others with your invitation link. Once the invited person has painted their first picture, you receive a quarter of a coffee.

You can become an ambassador voluntarily in your account. You then receive, instead of the quarter, a whole coffee for every person invited via your link as soon as they have a confirmed account and have painted their first picture; at most 50 coffees per year.

If an invited person buys credit, you receive 25 per cent of their first purchase in coffees, and the person who invited you 5 per cent (second level). Purchase rewards and the quarter coffees for first pictures share a cap of 30 coffees per year.

Rewards are credit, never money. Credit earned from rewards can be redeemed from 20 coffees upwards as a voucher at Boesner or Gerstaecker. Your own secondary accounts do not count; rewards obtained through abuse (fake accounts, self-invitation, disposable addresses) may be reversed. The former beta tester programme has been replaced; credit already granted remains.

Shape it with us: for a useful hint about using the app you receive half a coffee once the operator approves it; at most three per day and 30 coffees in total.

6. The AI coach

The coach is a learning aid provided without warranty. It can be wrong, and it paints nothing: you paint the picture. It does not answer questions that have nothing to do with painting. Two levels are available, "Maestro" and "Assistant"; they differ in accuracy, speed and price. The AI provider, currently Anthropic (USA), receives photos and questions, short summaries of earlier sessions (the coach's memory), the texts of "Shape it with us" hints (for assessment), photos for the automatic recognition of medium and level, and app texts for translations (without personal data); see privacy policy. A daily quota of requests and costs applies per account; child profiles are additionally subject to daily limits for sessions and questions, set by the adult. The same question is not charged twice within one session. We use your thumb ratings of answers and star ratings of sessions to improve the coach.

7. Groups, diary, meeting points, testimonials

What you share in groups is seen by its members and, depending on the setting, by everyone with the link or password. Your diary is public under an address of your choosing (name.1me.eu) or protected by a password; you are responsible for its contents: no images to which you hold no rights, no people without their consent, no names or photos of other people's children. Meet-ups in the calendar come from public sources or from users and are checked by hand; check the place and time with the organiser, we are not liable for the meet-up itself. Testimonials with your chosen name and a work are shown only with your express consent and only after release; you can withdraw this at any time.

8. Deleting your account

You can delete your account yourself at any time. All your data is removed in the process: photos, works, sessions, diary, group posts, child profiles, feedback and credit; unused credit expires without refund, with the exception of the withdrawal under section 4. Deletion is free of charge. Data remains in backup copies for up to 30 days.

When you delete, we ask you whether you would like to leave behind a work of your choice as an anonymous donation, without name, place or date. It shows later users what was created here. This is voluntary; without your yes, nothing remains. We continue to count the number of people who have used the service, without any personal reference.

9. What we may and may not do

We may develop the app further, adjust prices in coffees (announced in advance, with no effect on credit already purchased), change the AI provider and block accounts in cases of abuse. We are not liable for damage arising from the use of the learning aids, nor for outages of the service. Swiss law applies, the place of jurisdiction is the provider's registered office; mandatory consumer rights of your country of residence remain reserved. The German version is authoritative.
